Terms and Conditions

Definitions
The company means Apex Promotions Ltd.
The customer means the firm/person who has contracted to purchase the goods from the company.

Pricing Policy
All Quotes / prices exclude GST.
While we do our best to make sure that all pricing on our website is up to date it is only indicative and should not be assumed to be the true price.  For an exact price, please contact us and we will provide current up to date pricing/quote.

Payment
All invoices are deemed accepted by the Customer 7 after delivery and payable within the payment terms set out in the invoice.
The Customer is responsible for the legal and any other cost related, if an invoice is not paid on time and debt recovery actions are taken by Apex Promotions.

Artwork
If artwork is not supplied in correct format, artwork charges are billed at $60 +GST per hour. Some minor artwork may be done at no cost. Please check with us and we can supply a quote.

Delivery & Shipping
We make best efforts to ship your promotional goods to your desired destination in the most economical way possible given your specified date and production limitations.  Any delivery date or time provided is an estimate only and we take no responsibility for delays that are result of a third party e.g. courier or freight forwarder.

We reserve the right to charge additional freight where required. 

Quantity
Unless otherwise agreed the company will deliver the quantity specified or over runs and under runs will not exceed 10% of the quantity ordered. The customer will pay for the actual quantity delivered within this tolerance.

Retention Of Goods
All goods remain the property of Apex Promotions until they have been paid for in full.

Sample Policy
Samples are available on request and maybe invoiced when sent out.
Samples must be returned within ten days of receiving them and must be returned in the same condition and packaging as they were received otherwise the client will be liable to pay for the goods. All freight costs will be invoiced and are to be covered by the client.

Freight
where no freight company is specified on your order, we will ship by our carriers (fastest and most economical means) and add freight costs to the client’s invoice.

Claims
The company reserves the right NOT to accept any claims or complaints for errors or short delivery if not made within 10 days of receiving the order.
The company reserves the right to credit or replace any errors as it sees fit.

Insurance
Insurance on goods in transit is at the client’s risk.

Alterations / Cancellations
Once placed, an order cannot be cancelled unless agreed in writing by Apex Promotions.  All charges incurred will be invoiced.

Website and flyer Image
Colours of items shown on our website and any printed material are only indicative and must not be used for exact colour match.  Always ask for a sample or PMS Number when an exact colour match is important.

Privacy Policy
Apex Promotions does not sell nor rent your personal information to third parties.
We send our members emails throughout the purchasing process and other newsletter emails they elect to receive.
Our site’s registration form requires you to provide us contact information and your contact information may be used to contact you when necessary.

Information Collected
We do collect information about the way in which people are using our website in order to improve the value of our service. We don’t use the information for any other purpose.

Password
You are responsible for all actions taken with your username, email address and password

Direct Marketing
We may use or disclose the personal information for direct marketing purposes to inform you of, among other things, new products, promotions and discounts.
We will also give you the opportunity to opt out of receiving direct marketing communications.
